What Illinois Law Requires for an Uncontested Divorce

How to File for Uncontested Divorce in Cook County

Under the IMDMA, at least one spouse must have been an Illinois resident for at least 90 days before the court can enter a final judgment of dissolution. The petition is filed in the county where either spouse resides, so Cook County residents file here. The general steps are as follows:

• File the Petition for Dissolution of Marriage with the Cook County Domestic Relations Division, along with a Summons notifying the other spouse.
• Serve the Other Spouse with the filed documents as required by Illinois law.
• Attend the Initial Hearing, where the court reviews the paperwork and may schedule a date for the final hearing.
• Complete the Marital Settlement Agreement addressing property, debts, and, where applicable, spousal maintenance.
• File the Parenting Plan and Child Support Order if minor children are involved.
• Attend the Final Hearing, where the judge reviews all completed agreements and, if everything is in order, may enter the Judgment for Dissolution of Marriage.

The timeline for finalization is court-dependent and varies based on caseload, scheduling, and how quickly the required documents are completed. The Domestic Relations Division serves suburban Cook County through locations that include the Rolling Meadows Courthouse and the Skokie Courthouse.
