Frequently Asked Family Law Questions

Does Illinois Law Recognize Legal Separation?

The state of Illinois recognizes separation from your spouse as a legal status.

To be considered legally separated from your spouse, you will need to sort out an agreement on issues such as custody, child and spousal support, and property and asset division. The court will need to approve this agreement.

Please note that you cannot remarry if you are legally separated.

Should We Get Divorced or Separated?

It depends on the marriage.

Generally, legal separation is the best choice for those who are not yet sure they want to dissolve their marriage and want to work on things or for couples who do not want to legally divorce their spouse because of religious reasons, personal reasons, or the like.

Since legal separation is less permanent than divorce (your marriage will not actually be dissolved), many divorce lawyers recommend a couple tries out separation before deciding on whether to divorce. Keep in mind, however, it is still important to retain legal representation. This is because the terms of your separation will likely become the terms of your divorce, should you decide to split.
